Please read these Terms and Conditions ("Terms") carefully before using the Couch Rank web application or mobile application (collectively, the "Service") operated by Couch Rank ("we", "us", or "our").
By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Eligibility
You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction, whichever is higher) to use the Service. By using the Service, you represent and warrant that you meet this requirement.
If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
2. Accounts
2.1 Registration
To access most features of the Service you must create an account. You may register using an email address and password, or via Google Sign-In or Sign in with Apple. During registration you will choose a unique username (your handle), which becomes part of your public profile URL (couchrank.com/u/[username]).
2.2 Username Rules
Your username:
- Must be unique across the platform.
- May only contain letters, numbers, and underscores.
- Must not impersonate another person or entity or imply official affiliation with Couch Rank.
We reserve the right to reclaim or rename usernames that violate these rules.
2.3 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised access or suspected breach of security. We are not liable for any loss resulting from unauthorised use of your account.
2.4 One Account Per Person
You may not create or operate more than one account for the same person. Accounts created to circumvent a suspension or ban will be terminated.
3. Acceptable Use
You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the Service.
You must not:
- Post, upload, or share content that is unlawful, defamatory, harassing, abusive, obscene, or otherwise objectionable.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Attempt to gain unauthorised access to any part of the Service, other users' accounts, or our infrastructure.
- Use automated scripts, bots, crawlers, or scrapers to access or collect data from the Service without our prior written permission.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service to distribute spam, phishing attempts, or malware.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Circumvent any rate limits, access controls, or Firestore Security Rules.
- Violate any applicable laws or regulations.
We reserve the right to investigate and take appropriate action against violations, including suspending or terminating accounts.
4. User-Generated Content
4.1 Your Content
The Service allows you to create and store content, including show ratings, notes, tier list names and descriptions, group names, and profile bios ("User Content"). You retain ownership of any intellectual property rights you hold in your User Content.
4.2 Licence to Couch Rank
By submitting User Content to the Service, you grant Couch Rank a worldwide, non-exclusive, royalty-free, sublicensable licence to use, store, display, reproduce, and distribute that content solely for the purposes of operating and improving the Service (for example, displaying your tier ratings in Global Rankings).
4.3 Public Content
Content you make public (including your public tier grid, public custom tier lists, and your public profile) is accessible by anyone. You are solely responsible for ensuring that content you make public does not violate any laws or third-party rights.
4.4 Content Standards
You must not include in your User Content:
- Content that infringes copyright, trade marks, or other intellectual property rights.
- Personal information of other individuals without their consent.
- Content that is defamatory, harassing, or discriminatory.
We reserve the right to remove any User Content that violates these standards without notice.
5. Third-Party Content and Services
5.1 TMDB
Show and movie metadata (titles, synopses, posters, episode data) is provided by TMDB — The Movie Database. This data is the property of TMDB and its contributors and is used in accordance with TMDB's terms of service. Couch Rank is not endorsed or certified by TMDB.
5.2 External Links and SSO Providers
The Service integrates with Google Sign-In and Sign in with Apple. Your use of those services is governed by Google's and Apple's respective terms and conditions. We are not responsible for the content or practices of third-party services.
6. Intellectual Property
All rights, title, and interest in and to the Service (excluding User Content), including its design, source code, branding, logos, and documentation, are and remain the exclusive property of Couch Rank. Nothing in these Terms transfers any ownership of our intellectual property to you.
You may not copy, modify, distribute, sell, or lease any part of the Service or its content without our express written permission.
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our data practices.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation.
We do not warrant that:
- The Service will always be available or free from errors or bugs.
- Show metadata sourced from TMDB will be accurate, complete, or up to date.
- Any defects will be corrected.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Couch Rank and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service.
Our total cumulative liability to you for any claims arising from or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $100.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above may not apply to you.
10. Indemnification
You agree to defend, indemnify, and hold harmless Couch Rank and its operators from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.
11. Account Termination
11.1 Termination by You
You may delete your account at any time from the Account page. Account deletion is permanent and irreversible. All your data — including your show list, tier ratings, notes, and custom tier lists — will be permanently removed.
11.2 Termination by Us
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease.
11.3 Effect of Termination
Sections 4, 6, 8, 9, 10, and 13 of these Terms will survive any termination of your account.
12. Modifications to the Service
We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in the jurisdiction where Couch Rank operates.
If you have a dispute with us, we encourage you to contact us first at the address below to seek an informal resolution before initiating any formal proceedings.
14. Changes to These Terms
We may update these Terms from time to time. We will indicate the date of the most recent revision at the top of this page. For material changes, we will endeavour to notify you via the email address on your account. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms otherwise remain in full force and effect.
16. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Couch Rank regarding your use of the Service and supersede all prior agreements and understandings.
